Appeals Court Rules Trump's Federalization of California National Guard in LA Was Unlawful

The Ninth Circuit ruled 2-1 on Oct 23 that President Trump's June 2025 federalization of about 4,000 California National Guard troops deployed to Los Angeles was unlawful, rejecting the administration's 'rebellion in LA' and 'unreviewable deployment' claims.

Why it matters

The US Ninth Circuit Court of Appeals ruled 2-1 on Friday, Oct 23, that President Trump's June 2025 federalization of about 4,000 California National Guard troops, deployed to Los Angeles amid immigration-enforcement protests, was unlawful and an abuse of power. The case is Newsom v. Trump (No. 25-3727); the published opinion is binding on federal courts across nine western states.

The majority opinion, written by Judge Jennifer Sung and joined by Judge Eric Miller, rejected two government arguments: that a 'rebellion' existed in Los Angeles — the majority found most protesters were peaceful — and that presidential emergency deployments are beyond judicial review. Judge Mark Bennett dissented. The Justice Department's motion to dismiss had been denied.

Full report

The deployment took place in June 2025 during immigration-enforcement protests, over the public objections of California Governor Gavin Newsom. The ruling extends a December Supreme Court precedent in a related Illinois case. Newsom called Oct 23 'a pivotal day for the rule of law' in a statement.

The White House has not yet responded to the ruling, and the case could be appealed further. The decision will directly shape the boundaries of federal National Guard deployments in the states.
