Los Angeles City Council votes 14-0 to ban nitrous oxide sales at smoke and cannabis shops

The Los Angeles City Council voted 14-0 on Oct. 7 to adopt an ordinance banning tobacco and cannabis retailers from selling or distributing nitrous oxide ('laughing gas'), with fines up to $1,000 or six months in jail; it now goes to Mayor Karen Bass.

Why it matters

Nitrous oxide abused as a recreational inhalant can cause oxygen deprivation and neurological and cardiovascular harm, and discarded canisters litter streets as a neighborhood blight. The move complements California's new laws SB 758 and SB 9336, making Los Angeles the latest major U.S. city to crack down on retail abuse of 'laughing gas.'

The Los Angeles City Council voted 14-0 on Wednesday, Oct. 7, to adopt an ordinance prohibiting tobacco and cannabis retailers from selling, distributing or offering for sale nitrous oxide ('laughing gas') products, flavored or not. Violators face fines of up to $1,000 and/or up to six months in county jail.

The ordinance exempts medical, industrial, automotive and food-service uses, as well as pre-packaged food products that use nitrous oxide solely as a propellant, such as whipped cream. It now goes to Mayor Karen Bass for consideration.

The council separately asked the City Attorney to draft an expanded ordinance allowing criminal charges against any retailer selling nitrous oxide without a legitimate use. The measure was sponsored by Councilmembers Imelda Padilla and Eunisses Hernandez after about two years of work. Background: the FDA warned in 2025 against recreational inhalation of nitrous oxide.
