At about 4 p.m. on Thursday (Oct. 8), ICE agents opened fire during an enforcement operation in New York's Marble Hill neighbourhood, firing at least seven rounds; Oscar Belgal, a 28-year-old Dominican national, was struck in the neck. His 5-year-old son was sitting in the back seat and was unhurt. NYPD Commissioner Jessica Tisch confirmed the NYPD was not part of the operation and arrived about ten minutes later to secure the scene.
On Friday (Oct. 9), U.S. District Judge J. Paul Oetken signed an emergency order barring Belgal's deportation — and barring his transfer to any facility outside the Southern District of New York, the Eastern District of New York and the District of New Jersey — while his habeas petition is heard. Belgal's lawyers told the judge that ICE took him from the hospital in unmarked vehicles on Thursday evening to an out-of-state detention facility, with the bullet still lodged in him.
Homeland Security Secretary Markwayne Mullin defended the agent on Friday, saying the agents did not know a child was inside the car when they fired, and that Belgal refused orders, drove toward officers and struck two federal vehicles — 'weaponizing' the car; DHS also cited the man's grand larceny conviction and a pending drug case. The NYPD released responding officers' body-camera footage the same day.
The incident has sparked days of protests: demonstrators gathered at the scene and outside the hospital, and four people have been arrested in the ensuing protests. The investigation continues.
