São Paulo court rejects prosecutors' demand for 48-hour storm-damage explanation

A São Paulo court on Friday denied the state prosecutors' urgent request that city hall explain within 48 hours its response to the October 14 storm; the judge said the case concerns only the city's flood-plan obligations, which remain within deadline.

Why it matters

The October 14 downpour flooded tunnels, left cars floating and delayed flights in São Paulo. Prosecutors tried to force city hall to account for its emergency response within 48 hours, but the court ruled that request falls outside the case. The post-storm legal battle enters a new round.

The ruling

Judge Yuri Cesar Serapião Soares Pereira of São Paulo's 13th Public Treasury Court ruled on October 16: the urgent request by the São Paulo Public Prosecution Service (MPSP) requiring the city to explain, within 48 hours, its response to the storm damage was denied. The prosecutors had asked whether Civil Defense was activated and whether affected residents received assistance. The judge held that the case concerns only the obligation to present short-, medium- and long-term flood intervention plans, and the city remains within the deadline.

Background

The prosecutors separately accuse the city of missing deadlines for flood plans, seeking fines of up to R$1.8 million and demanding drainage-works schedules within 10 days. City hall responded that the three intervention plans were already submitted to the court in December 2025 and are being updated based on the third edition of the Drainage Master Plan published in September 2026, with works proceeding on schedule.
