São Paulo upholds R$11.4 million fine against Enel over late-2025 blackouts

The São Paulo city government confirmed on October 21 in the official gazette that it is upholding consumer-protection agency Procon's R$11,428,615.57 fine against Enel Distribuição São Paulo for power supply failures between September and December 2025, including early-December blackouts that left millions without electricity. Enel has 15 days to appeal.
Why it matters
This is the administrative reckoning for São Paulo's wave of blackouts late last year: the city found Enel at fault over supply continuity, customer service and information to users. Separately, Brazil's electricity regulator ANEEL is running a process that could terminate Enel's concession in São Paulo — with even bigger stakes.
The fine
The penalty was originally imposed by Procon Paulistano in 2025. After Enel appealed, the municipal justice department signed order No. 004/2026 on October 20 and published it in the city's official gazette on October 21, confirming the fine of R$11,428,615.57. The legal basis includes Article 22 of the Consumer Defense Code, Article 20 of Federal Decree 2,181/97, and Article 362 of ANEEL Normative Resolution 1,000/21; one mitigating and two aggravating circumstances were recognized.
Full report
Procon's investigation found service interruptions, failures in phone customer service and a lack of information to the public. The December 8–10, 2025 blackouts were the worst episode — the city's probe says up to about 3 million consumers lost power; Enel says strong winds hit its concession area for two days affecting about 4.4 million customers, and that it restored supply to 80% of them (around 3.5 million) within 24 hours.
Enel said it disagrees with the penalty, arguing its response to the extreme weather events of September and December 2025 was proportionate to the scale of the damage, and that its December restoration was faster than during the November 2023 and October 2024 events.
Next steps: Enel has 15 days to file an administrative appeal with Procon Paulistano's coordination office; waiving all appeals and paying within 30 days earns a 30% discount. Also in motion: ANEEL opened a process in April 2026 recommending the termination of Enel's São Paulo concession after the major blackouts of 2023, 2024 and 2025, and rejected Enel's appeal in August, so that process continues.
