In an X post, the White House said President Trump and the DOJ are moving to crack down on noncitizen voting, with violators prosecuted "to the fullest extent of the law."

Why it matters

With the midterm elections on November 3, election integrity has become a flashpoint between the parties. The White House's naming of the Justice Department as the enforcement instrument marks a new escalation of the federal push against noncitizen voting.

WASHINGTON — The White House posted on X on Tuesday, October 6, declaring that President Donald Trump and the Department of Justice are moving to crack down on noncitizen voting, while accusing Democrats of having "looked the other way" for years. Anyone who "illegally votes" faces prosecution "to the fullest extent of the law," the post said.

The statement cited no case numbers, pending legislation, or a named DOJ program — making it, at present, a declaration of intent rather than a detailed policy rollout. Noncitizen voting in federal elections is already illegal under existing U.S. federal law.

A Reuters investigation published September 23 found the Justice Department had brought criminal charges against about 20 people this month under the "voting by aliens" statute — roughly 13% of all prosecutions under the law in its three decades. The Department of Homeland Security's investigative arm has mobilized hundreds of agents across all 50 states. Supporters say any illegal voting undermines democratic legitimacy; critics point to studies showing noncitizen voting is extremely rare and warn the campaign could erode public trust in elections.
