Appeals court weighs legality of Trump's National Guard deployment in Washington, D.C.

A federal appeals court heard arguments Wednesday on the legality of President Trump's National Guard deployment in Washington, D.C., pressing government lawyers on the limits of presidential power; a district judge ruled the deployment illegal last November.

Why it matters

The U.S. Court of Appeals for the District of Columbia Circuit heard arguments on Wednesday, October 14, on the legality of President Donald Trump's deployment of National Guard troops in Washington, D.C. Judges pressed government lawyers on whether any real limits exist on a president's authority to send troops into the city to support law enforcement — in particular whether the deployment runs into the Posse Comitatus Act, the long-standing law restricting the use of the military for domestic law enforcement, and whether it intrudes on local officials' authority to direct policing.

The case follows a ruling last November by a federal district judge that the deployment unlawfully interfered with local officials' authority to direct law enforcement in the district; the appeals court then paused that ruling, allowing the Guard to remain in place while the case moves through the courts. The Guard has patrolled the capital's streets since August 2025 as part of a crime-fighting mission, peaking at about 5,000 troops, with the deployment expected to run through January 2029. Dozens of protesters gathered outside the courthouse Wednesday holding signs reading "Guards Out" and "Free DC".

The stakes

Supporters say the deployment restores order; critics say it blurs the line between civilian policing and military presence and sets a precedent for expanding executive power. However the court rules, the decision will shape the limits of presidential authority to use the military at home: a ruling for the government would strengthen claims of wide presidential latitude in the District, while a ruling against it would reinforce the principle that even the president must respect clear legal boundaries.
