In a letter Tuesday to Homeland Security Secretary Markwayne Mullin, Sen. Patty Murray of Washington, the top Democrat on the Senate Appropriations Committee, and Sen. Chris Murphy of Connecticut, the ranking Democrat on the Homeland Security funding subcommittee, said the money comes from Trump's so-called "One Big Beautiful Bill" and was supposed to go to U.S. Customs and Border Protection.

"We should not have to remind you that using government funding to create or air political ads like the ones that have been running over the last few days is illegal and a shockingly corrupt misuse of taxpayer dollars," they wrote, demanding answers within 48 hours. They asked whether DHS plans to spend additional federal funds on the ads, demanded contracting information, and asked whether Mullin had spoken with Trump about using taxpayer funds for the commercials.

The ads began airing last week during college and NFL programming, with on-screen disclosures saying they were "Paid for by the U.S. Government." Criticism has come from both parties: Senate Majority Leader John Thune said, "It's a great message, I like the message, but it shouldn't be paid for with taxpayer dollars," and legal experts cited the federal law against using appropriated funds for "publicity or propaganda." The White House has defended the spots as public service announcements, while Axios reported Trump is personally selecting the ads and an administration official said, "This is just the beginning."
